À partir du singulier constat que les lois contiennent un certain nombre d’affirmations de type factuel, l’auteure s’interroge sur l’utilisation judiciaire de ces dernières lors du contentieux constitutionnel canadien. Elle y découvre une quasi ignorance de cette éventuelle contribution des législateurs à la construction du fondement factuel pourtant dit essentiel à tout prononcé judiciaire sur la constitutionnalité d’une loi. Après une première réaction de consternation face à une \ntelle nonchalance à l’égard de prononcés explicites de la part de l’organe démocratique de l’État, l’auteure observe cependant que la légitimité démocratique n’est nullement garante de la validité de conclusions factuelles, et que le caractère essentiellement politique de l’exercice de la fonction législative met en péril l’objectivité des déclarations de fait que l’on retrouve dans les lois. Somme toute, les tribunaux canadiens ont peut-être raison de n’attribuer qu’un rôle mineur aux affirmations factuelles du législateur.
