Droit au logement, droits des malades, égalité des droits et des chances, participation et citoyenneté des personnes handicapées, droit à un revenu minimum, etc. La référence aux droits subjectifs n'a cessé de gagner en importance dans la production législative, en France comme dans d’autres pays occidentaux.L’État peut-il garantir la réalité de ces nouveaux droits reconnus aux individus ? De quelles capacités les acteurs publics disposent-ils pour les mettre en oeuvre ? Comment les revendications en termes de droits contribuent-elles à transformer les modalités d’intervention étatiques et à déplacer les frontières de l’action publique ?L’ouvrage enquête sur cet « État des droits », à partir de différents cas nationaux, en Belgique, au Canada, en France et en Suède et dans divers secteurs de l’action publique – handicap, discriminations, santé, logement, politiques scolaires. Il montre comment des institutions étatiques, par leurs pratiques quotidiennes, font ou défont les droits des individus. Il prête une attention particulière aux nouvelles organisations (Ombudsman, maisons départementales des personnes handicapées, Halde) qui, hors de l’arène judiciaire, participent de cette politique des droits via des dispositifs de médiation, d’accès aux droits ou d’attribution des droits.Une exploration fine des pratiques des droits dans l’action publique, enrichie des apports du droit, de la sociologie et de la science politique.
