Indonesia sebagai negara yang mayoritas beragama islam mulai memilih alternatif kegiatan perbankan sesuai dengan Al-Quran dan Sunnah dengan tanpa menggunakan riba yakni perbankan syariah. Salah satu produk perbankan yang banyak dipilih adalah pembiayaan murabahah. Namun Indonesia belum memiliki pengaturan norma terkait kepailitan dalam pembiayaan murabahah yang mengakibatkan masih bercampurnya aturan pada kepilitan konvensional dan kepailitan sesuai dengan prinsip syariah. Terlebih terkait dengan penyelesaian sengketa kepailitan pada pembiayaan murabahah dengan adanya Putusan MK No. 93/PUU—X-2012 yang mereduksi Pasal 55 ayat (2) UU Pebankan Syariah.
