La pollution marine par les plastiques est un enjeu transfrontalier, dans la mesure où, si elle traverse les frontières par l’air ou par l’eau, elle cause plusieurs dommages à l’environnement d’autres régions. Dans une pers pective nationale, les États n’ont pas été en mesure d’exercer correctement leur contrôle ni à l’intérieur de leurs frontières ni au-delà. En raison du problème croissant, depuis 2014, des débats internationaux sur l’émergence de cette pollution ont eu lieu jusqu’au 2 mars 2022, date à laquelle l’ONU a adopté la Résolution 5/14, « Mettre fin à la pollution plastique ». Avec cette résolution, les États membres expriment leur intérêt à conclure un traité sur les plastiques au plus tard en 2024. La présente étude vise à analyser des mesures commerciales et environnementales qui pourraient être envisagées dans l’accord et à établir les limites de ces deux aspects du futur traité. Dès lors, il faut réfléchir sur le type de gouvernance internationale sur la lutte contre la pollution marine par le plastique qui est en cours.
