L'articolo commenta le Conclusioni dell'Avvocato generale nei ricorsi per annullamento presentati da Ungheria e Polonia contro il regolamento dell'Unione europea in materia di condizionalità legata al rispetto dello Stato di diritto negli Stati membri, a tutela degli interessi finanziari dell'Unione. Si osserva che, pur essendo apprezzabile e condivisibile la conclusione di proporre alla Corte di rigettare il ricorso, l'Avvocato generale esprime cautela e ricerca di un difficile compromesso in una materia cruciale per la promozione del rispetto dei principi dello Stato di diritto nei paesi membri, in una fase in cui tali principi sono messi in discussione in alcuni di essi.
