In het Smallsteps-arrest uit 2017 oordeelde het Hof van Justitie van de EU dat de uitzondering die in Richtlijn 2001/23/EG inzake overgang van ondernemingen is opgenomen voor de faillissementsdoorstart, niet van toepassing is wanneer een dergelijke doorstart wordt gerealiseerd met gebruikmaking van de pre-packmethode. In het Heiploeg-arrest van april 2022 blijkt het Hof over deze kwestie een compleet ander standpunt in te nemen. Na een korte introductie van de relevante Europese regelgeving en weergave van de belangrijkste overwegingen uit het Smallsteps-arrest, bespreekt de auteur de Heiploeg-zaak en staat hij stil bij de implicaties van het recente Hof-arrest voor de Nederlandse <br/>doorstartpraktijk.
