Per effetto degli attentati dell’11 settembre 2001 e dell’intensificazione dell’attività terroristica internazionale nonché degli attacchi rivolti alle democrazie occidentali, la radicalizzazione delle tradizionali criticità del rapporto tra garanzie dei diritti fondamentali e istanze di sicurezza individuale e collettiva ha pervaso tutte le formule di concreta declinazione della sicurezza nazionale: il segreto di Stato, idealmente considerato quale veicolo di preservazione della stessa, con l’emergenza terrorismo si è rivelato la cartina al tornasole della tenuta democratica degli ordinamenti contemporanei. Negli ultimi anni la disciplina normativa del segreto e la ricaduta giurisprudenziale della sua applicazione e interpretazione hanno guidato la metamorfosi del rapporto tra autorità e libertà e dell’assetto dei poteri in ciascuna esperienza statuale sollecitando la riflessione intorno alle problematiche connesse alla ricerca perenne di un equilibrio tra garanzia dei diritti e sicurezza dello Stato sullo specifico terreno delle garanzie processuali del segreto.
