INCE 1994, NAFTA has dramatically changed how investors pursue international business in Canada, Mexico, and the United States.Because NAFTA was created with the purpose of substantially increasing investment opportunities in the free trade area, 1 it was imperative that NAFTA implement regulations to protect these investors from discrimination by the government of the state in which the investor was investing.Chapter 11, the Investment Chapter, is deemed to be that protection for investors.By examining the Investment Chapter, the three successful Chapter 11 claims by foreign investors, and the impact of this jurisprudence, foreign investors can effectively and successfully respond to appellate procedures under the NAFTA dispute resolution process.I.
