Oikeus terveyteen : paperittoman lapsen oikeus terveydenhuollon palveluihin

Abstract
Tutkielmassa selvitetään, kuuluuko pääsy perusterveydenhuollon palveluihin osaksi kansainvälisissä ihmisoikeussopimuksissa turvattua oikeutta terveyteen lapsien kohdalla ja jos kuuluu, voidaanko tätä oikeutta rajoittaa paperittoman lapsen kohdalla. Jatkona näille kysymyksille tutkimuksessa selvitetään, turvaako Suomi paperittoman lapsen oikeuden terveyteen asianmukaisesti. Suomen osalta asiaa tarkastellaan sekä tällä hetkellä vallitsevan tilanteen osalta, että siltä kannalta, että HE 343/2014 vp olisi vahvistettu laiksi. Kansainvälisten ihmisoikeussopimuksien osalta tutkielmassa käsitellään vain aiheen kannalta merkittävimmät ihmisoikeussopimukset (YK:n TSS-sopimus, YK:n lapsenoikeuksien sopimus, Euroopan ihmisoikeussopimus, Euroopan sosiaalinen peruskirja sekä biolääketiedesopimus.) Asiaa tarkastellaan lisäksi EU:n kannalta sekä Suomen ja eräiden muiden EU:n jäsenmaiden kannalta. Tutkielman ulkopuolelle on rajattu muut kuin terveydenhuollon palvelut oikeuden terveyteen osatekijöistä samoin kuin äitien ja raskaana olevien naisten oikeus terveyteen näiden aiheiden kiistattomasta yhteydestä lapsen oikeuteen terveyteen huolimatta.
