Abstract
Sosiaali- ja terveysministeriö käynnisti 12.2.2014 selvityksen Suomen asumisperusteisen sosiaaliturvan ja EU-lainsäädännön vaatimusten yhteensovittamisesta. Selvitystä laatimaan nimettiin varatuomari Jukka Ahtela ja suunnittelupäällikkö Essi Rentola. Selvityksen tueksi pyydettiin eduskunnan apulaisoikeusasiamies Maija Sakslinilta lausunto Suomen ja EU:n toimivallasta sosiaaliturvassa sekä Suomen kansallisen lainsäädännön liikkumavarasta. Selvitystehtävä oli tarkastella Suomen asumisperusteista sosiaaliturvaa ja EU:n lainsäädännön yhteensovittamisen vaatimuksia sekä Suomen kansallisen lainsäädännön liikkumavaraa. Selvityksessä arvioitiin haasteita ja kehittämisvaihtoehtoja erityisesti yhdenvertaisen kohtelun periaatteen näkökulmasta. Selvitystyön johtopäätöksenä on, että Suomessa tulisi osallistua EU-lainsäädännön kehittämiseen entistä aloitteellisemmin ja aktiivisemmin. Kansallisen lainsäädännön valmistelussa tulisi myös jo lain valmistelun alkuvaiheessa ottaa huomioon EU-lainsäädännön mahdolliset vaikutukset.
