Abstract
Het is inmiddels twintig jaar geleden dat de Hoge Raad het arrest Contrair gedrag heeft gewezen, waarin is beslist dat onderling overeenstemmend gedrag van echtgenoten van belang is bij de vraag of afgeweken dient te worden van huwelijkse voorwaarden op grond van de redelijkheid en billijkheid. Tot dusverre heeft deze uitspraak er niet toe geleid dat nadelige gevolgen van koude uitsluiting bij echtscheiding worden gemitigeerd. Toch is hier alle aanleiding toe. Een ongelijke taakverdeling tussen echtgenoten is bij uitstek gedrag dat afwijkt van koude uitsluiting. Dit artikel bespreekt en evalueert de huidige stand van zaken.
