Abstract
Il varo di una normativa organica dedicata alla giustizia penale riparativa costituisce una rimarchevole novità della riforma processuale portata a compimento con il D.Lgs. 150/2022. La procedura vi è regolata come articolazione separata dall’ordinaria procedura penale, eppur destinata a condizionare gli esiti di quest’ultima. La base comunitaria che ne costituisce il fondamento apre scenari inediti e problematici già sul piano organizzativo, oltre che con riguardo alle partecipazioni soggettive, alle dinamiche procedimentali proprie della mediazione e alle interferenze con l’ordinaria procedura penale. Pur definita come “organica”, la disciplina in questione lascia ampi spazi alle pratiche dei mediatori esperti sull’abilità e preparazione dei quali grava, in buona misura, il destino di un’ardita scommessa.
