La justice communautaire comme projet d'autodétermination chez les Atikamekw Nehirowisiwok d'Opitciwan

Abstract
Le Système de protection sociale des Atikamekw d’Opitciwan et le Comité de justice sociale d’Opitciwan sont deux programmes de justice communautaire en vigueur dans la communauté des Atikamekw Nehirowisiwok d’Opitciwan, une nation autochtone du Québec. Ces initiatives font office d’une prise en charge locale de certains conflits internes, notamment de certaines infractions en matière criminelle et socioprotectionnelle. Ces projets ont été explicitement mis en place dans une démarche d’autodétermination du peuple Atikamekw Nehirowisiw et en réaction à certaines insatisfactions à l’égard du système juridique étatique. Cet article a pour objectif d’explorer cette aspiration à l’autodétermination via la prise en charge locale des conflits internes. Concrètement, ces programmes de justice communautaire visent à résoudre certains conflits internes d’une manière qui soit considérée comme appropriée et légitime par la population d’Opitciwan. À partir d’une enquête de terrain réalisée en 2014 à Opitciwan, je proposerai ici 10 principes qui caractérisent ce que représente une résolution légitime des conflits internes aux yeux des Atikamekw Nehirowisiwok d’Opitciwan, principes que leurs initiatives de justice communautaire tentent de mettre en application.
