Abstract
En droit québécois, la propriété dispose d'une protection minimale qui permet au législateur et aux municipalités de limiter son exercice de manière importante. À cet égard, la vétusté immobilière constitue depuis l'époque de la Nouvelle-France un motif d'intérêt général offrant aux corps publics des pouvoirs pour forcer l'entretien et la démolition d'immeubles susceptibles de causer un préjudice à autrui ou de porter atteinte à la sécurité publique. Si ces pouvoirs existent depuis longtemps en droit québécois, les récentes modifications à la Loi sur l'aménagement et l'urbanisme, en 2017, ont permis d'accroître leur portée en donnant la capacité aux municipalités d'intervenir plus largement en ce domaine. La Loi sur l'aménagement et l'urbanisme ainsi que le Code civil du Québec contiennent de nombreuses dispositions qui permettent aux municipalités québécoises de limiter l'exercice du droit de propriété en assurant l'entretien ou la démolition d'immeubles vétustes sur leur territoire. Ce mémoire propose une lecture théorique, pratique et critique de ces pouvoirs à l'heure où les enjeux de protection du patrimoine culturel et de participation citoyenne animent le débat public.
