The Court has played a significant role in the dialogue between indigenous representatives and their Federal and Provincial counterparts since the Supreme Court judgement related to the Calder case which allowed to initiate a long term process that has led to the negotiation and ratification of the first British Columbia modern treaty by the Canadian Government, the Provincial one and the Nisg'a community. However, despite the apparent development of the relations between the Aboriginal people and the Federal and Provincial governments, the indigenous communities see more and more frustrated their demands for rights’ guarantees because of the imbalance of power that characterizes the dialogue between the two parts.
\nThis article is aimed to analyze the role of the Supreme Court case law in relation to the composition of this relationship.
