Il saggio analizza l'evoluzione registrata nell'interpretazione dell'articolo 28 della Convenzione di Varsavia-l'Aja e dell'articolo 33 della Convenzione di Montreal del 1999, sul trasporto aereo internazionale, dalla seconda metà del secolo scorso ad oggi. Attraverso un esame dettagliato delle decisioni giurisprudenziali e delle riflessioni della dottrina sulla portata dei criteri di connessione fissati da tali norme, lo scritto si sofferma con particolare attenzione sull'ambito di applicazione del criterio del "place of business through which the contract has been made" nel caso di acquisto diretto online del biglietto di viaggio, alla luce dell'ordinanza 2019 n. 18257 delle Sezioni Unite della Corte di Cassazione e della decisione della Corte di giustizia resa nella causa Guaitoli c. easyJet Airline Co.Ltd.
