Le marché de l'art, opaque, peu réglementé, internationalisé et connaissant une forte spéculation, s'avère être un lieu propice à la réalisation de trafics et particulièrement au blanchiment d'argent. Si cette infraction commise au sein du marché a longtemps suscité peu d'intérêt par rapport à d'autres secteurs, certaines affaires médiatiques et particulièrement le contexte terrorisme ont souligné son impact. Aussi, il s'est avéré nécessaire d'intervenir et d'assainir ce marché de sorte que depuis 2001, les professionnels du secteur de l'art, à l'image de ceux du secteur financier, sont soumis aux obligations du régime de lutte contre le blanchiment d'argent et le financement du terrorisme impulsé au niveau international par le GAFI et plus particulièrement à l'échelle européenne. Cet assujettissement s'est renforcé au fil des directives jusqu'à récemment avec la transposition de la 5ème directive de lutte contre le blanchiment d'argent et le financement du terrorisme, transposé en février 2020 en droit interne. Il se trouve néanmoins que malgré les moyens mis en place, la lutte est assez peu efficace au sein de ce secteur les professionnels étant peu enclin à la conformité. Cette étude a pour fil conducteur d'étudier cette infraction et sa matérialisation au sein du marché de l'art, pour comprendre les raisons de cet échec et réfléchir à une possible amélioration. Ce marché ayant en outre une forte dimension internationale, l'objectif dans le cadre de mon double master franco-canadien est d'envisager quel est l'intérêt porté à cette question au Canada et un peu plus largement endroit nord-américain.
