Abstract
In the last fifteen years, the Supreme Court of Canada operated a substantial move regarding judicial review of administrative action. It abandoned the formal approach which rested upon a jurisdictional/non jurisdictional qualification in order to show more deference towards specialized agencies. The development of a pragmatic and functional analysis has led to the determination of appropriate standards of review for each decision. This thesis is divided in three parts. The first one is dedicated to the study of the fundamental principles underlying judicial review; the second part starts by examining the ultra vires doctrine and then proceeds to describe the different steps which led to a unified theory focussing on the determination of the appropriate standard of review. Finally, the last part looks at the way courts evaluate the tribunal's relative expertise and at the phenomenon of interpretive pluralism.
