Abstract
Lo studio ricostruisce il dibattito che ha coinvolto la dottrina costituzionalistica statunitense e canadese nel biennio 2004-2005, individuando alcuni profili di particolare interesse. Significative soprattutto le discussioni che hanno riguardato i provvedimenti legislativi e giudiziari in tema di terrorismo internazionale, azioni positive nelle università, matrimonio omosessuale e multiculturalismo. All’interno di tale tematiche si sottolinea il ruolo che nel dibattito ha giocato il rapporto tra corti supreme e legislatori nella risposta a nuove esigenze e a conflitti sociali.
