Abstract
În cadrul prezentului articol sunt analizate temeiurile constituirii unei fiducii, potrivit art. 2074 din Codul civil al Republicii Moldova. Pentru a face lumină asupra sursei de inspirație a legiuitorului și asupra caracteristicilor distincte ale diverselor metode de constituire, se efectuează un studiu comparativ cu privire la regulile prezentate în Cartea X (Trusts) din Draft Common Frame of Reference, precum și a celor cuprinse în Codurile civile din provincia Quebec, Franța, România și Republica Moldova. În context, se pune accent pe modalitățile de constituire voluntară a unei fiducii, și anume prin contract, declarație unilaterală și testament, toate acestea fiind reglementate în mod cuprinzător. În plus, articolul abordează mecanismul de creare a unei fiducii prin act administrativ sau hotărâre judecătorească, situații care necesită o reglementare legislativă expresă înainte de implementare. De asemenea, lucrarea stabilește corelația dintre „lege” și „act administrativ” în calitate de surse ale fiduciei, prezentând o ipoteză potrivit căreia legiuitorul a înlocuit intenționat acest termen în legislația Republicii Moldova.
