Abstract
The decentralization of the health care system in Quebec has imposed on local authorities, notably, the task of distributing financial resources made available to them. lt is up to the minister to determine the existence of these resources and to prescribe administrative conditions to be applied by the local authorities. The management is confronted with duties and responsibilities including some that are a direct result of an administrative error. There are many intervening parties in the decision making process of the Quebec health care system. We propose to study the judicial status of these local authorities in order to establish there liability in an extra-contractual matter following a neglectful decision on the part of the management exercising its function in discretionary manner.
