Abstract
Ce mémoire étudie l'applicabilité de la Charte canadienne des droits et libertés, de même que des instruments provinciaux et fédéraux de protection des droits et libertés de la personne aux Autochtones du Canada. En ce qui concerne la Charte canadienne, ce mémoire examine son champ d'application à l'égard des principaux types d'administrations autochtones. Il se penche ensuite sur le rapport entre les droits ancestraux ou issus de traités et la Charte canadienne en insistant sur le fait que la Constitution constitue un tout cohérent. Quant aux instruments provinciaux et fédéraux, ce mémoire s'intéresse à l'incidence que peut avoir le partage des compétences sur leur applicabilité. Pour ce faire, il s'interroge sur la nature des droits et libertés de la personne pour ensuite appliquer ces principes aux matières autochtones, tout en rappelant que tant les instruments provinciaux que fédéraux sont de rang constitutionnel inférieur aux droits ancestraux ou issus de traités.
