L'aîné vulnérable et la maltraitance à domicile : une problématique complexe

Abstract
Résumé: La maltraitance envers les aînés est un problème social ayant des conséquences sérieuses et elle est devenue une priorité pour les gouvernements. Nous abordons ce phénomène polymorphe en nous attardant d'abord aux notions générales pertinentes et en y apportant un regard critique. Le dépistage de telles situations est délicat puisqu'en plus des difficultés éprouvées par les professionnels, les portraits généraux des protagonistes demandent à être précisés. Notre étude se concentre sur les personnes âgées aptes mais vulnérables, notion qu'il n'est certes pas facile de cerner. Afin d'éviter l'âgisme, le Québec a refusé de se doter d'une loi particulière de protection des aînés, celle-ci reposant dès lors sur la Charte des droits et libertés de la personne, qui retient la notion d'exploitation. Par ailleurs, les professionnels, ne peuvent pas, en règle générale, dénoncer les situations de maltraitance en raison du secret professionnel auquel ils sont tenus. La décision de protéger une personne âgée maltraitée soulève ainsi des dilemmes juridiques et éthiques fort délicats. Nous traitons enfin différentes interventions mises en oeuvre pour tenter de faire face à ce problème social afin d'optimiser la protection des aînés vulnérables.||Abstract: Domestic elder mistreatment is a social problem with serious consequences which has become a priority for governments. We discuss a few generalities of this polymorphous phenomenon while criticizing it. Case detection is laborious because, in addition to the difficulties faced by professionals, the fact that general portraits of the protagonists remain to be clarified makes screening and protection of mistreated elders even more complex. Furthermore, our essay address domestic mistreatment in fully able elder persons that are vulnerable which notion is intricate. The province of Quebec refused to adopt specific legislation to protect older adults and has chosen the Charter of Human Rights and Freedoms and the protection afforded to seniors against exploitation. Moreover, professionals evaluating situations of mistreatment are prevented from reporting them, as a general rule, because they must abide by the principle of non-disclosure of confidential information. Thus, delicate legal and ethical dilemmas arise with the decision to protect a mistreated elder person. Finally, we outline different interventions implemented to address this social problem and to optimise the protection of vulnerable elders.
