Abstract
La violence conjugale a longtemps échappé complètement au droit du travail et notamment au régime de la santé et sécurité au travail. Ainsi, une travailleuse victime de violence conjugale devait soit en dissimuler les manifestations sur son lieu de travail, soit abandonner son emploi. Peut-on alors parler d’une lacune en droit? Est-il possible qu’une telle lacune soit socialement construite sur la base de mythes et stéréotypes de ce qui constitue effectivement un risque au travail et mérite alors une prise en charge par ledit régime? Finalement, est-il possible que le droit international puisse contribuer à faire en sorte que le législateur québécois comble une telle lacune? Cet essai propose une exploration de ces questions.
