L'abbandono genitoriale, quale costante omissione di tutti gli obblighi che il genitore ha nei confronti della prole, integra un illecito endofamiliare permanente, cosicché la peculiare natura di tale danno, che investe la progressiva formazione della personalità del danneggiato condizionando le sue capacità di comprensione e autodifesa, incide sul dies a quo della prescrizione, da individuarsi nel momento in cui la vittima è pervenuta alla concreta possibilità di esercitare la pretesa risarcitoria.
