Abstract
This thesis explores the state of environmental democracy in Quebec and British Columbia by analyzing the articulation of the environmental procedural rights in the two provinces. Those rights, which were constituted in three pillars in principle 10 of the Rio Declaration, are known as the right to environmental information, the right to public participation in decision making and the right to environmental justice. They are often used in the context of an environmental assessment. In order to shed light on the state of environmental democracy in the two provinces, an examination of the structure of their respective environmental assessment process will be done followed by a comparative analysis for each of the pillars. In doing so, this thesis will draw conclusions regarding each right and will propose different solutions to reinforce environmental democracy, including constitutionalizing the right to environmental information in some circumstances, identifying some legitimacy issues with the institutions carrying the environmental assessment, and creating specialized environmental courts.
