TEZ İ\nTemel hak ve özgürlüklerin sınırlanması ve sınırlamanın sınırını oluşturan ölçütler isimli tezimin birinci bölümünde, öncelikle temel ve hak ve özgürlüklerin nasıl sınırlandığı hususu ele alınmıştır. \n2001 yılında gerçekleştirilen Anayasa değişiklikleriyle temel hak ve özgürlüklerin Anayasa’da yer alan sınırlama rejiminde önemli değişiklikler yapılmıştır. 13. maddede 2001 yılı değişiklikleri öncesinde genel bir sınırlama rejimi söz konusu iken 2001 yılı değişikliklerinden sonra farklılaşmış-kademeli sınırlama sistemine geçilmiştir. Yeni sistemde temel hak ve özgürlüklerin sınırlanması konusu incelenmiştir. \nTezin ikinci bölümünde ölçülülük ilkesinin Alman, Fransız, Kanada ve Birleşik Devletler kamu hukuklarında nasıl uygulandığı incelenmiştir. \nÜçüncü bölümde ise, ulusal üstü boyutta ölçülülük ilkesinin uygulanması incelenmiştir. Bu bölümde Avrupa İnsan Hakları Mahkemesinin ölçülülük ilkesini nasıl uyguladığı incelenmiştir. \nDördüncü bölümde Türk Anayasa Hukuku’nda sınırlamanın sınırını oluşturan ölçütler incelenmiştir. Sırasıyla, Demokratik toplum düzeninin gerekleri ölçütü, ölçülülük ölçütü, öze dokunmama ölçütü, Anayasa’nın sözüne ve ruhuna uygunluk ölçütü ve laik Cumhuriyet’in gerekleri ölçütü incelenmiştir. İncelememiz sonucunda vardığımız sonuçlar, sonuç bölümünde yer almıştır. \n ABSTRACT\nThe issue of how fundamental rights and liberties are restricted is addressed in the first chapter of the thesis titled “Restriction Of Fundamental Rights And Liberties And The Criteria That Limit These Restrictions”. Significant changes have occurred in the constitutional regime of the restriction of fundamental rights and liberties with the amendments of 2001. The general restriction regime regulated in the article 13 was shifted to a gradual restriction system with these amendments. In this chapter, the restriction of fundamental rights and liberties has been examined under the new system. \nRegulations of the proportionality principle in the public law systems of Germany, France, Canada and the United States have been examined in the second chapter of the thesis. \nIn the third chapter, application of the proportionality principle in the supra-national level has been addressed. How European Court of Human Rights applies the proportionality principle has also been explored in this chapter.\nIn the fourth chapter, the criteria that constitute the limits of these restrictions have been addressed. Within this context, criteria of “requirements of the democratic order of a society”, “proportionality”, “prohibition of an impairment of the very essence of a right”, “conformity to the letters and spirit of the Constitution” and “necessities of a secular republic” have been examined. Finally, the observations come up with the research have been stated in the conclusion.
