ResumenEl presente trabajo busca explorar dentro del pensamiento jurdico schmittiano su recepcin del concepto aristotlico de justicia poltica en su interpretacin tomista.Con este fin la autora establece la interdependencia de los conceptos de legitimidad y obediencia y compara el concepto de obediencia en la recepcin tomista de Aristteles con el concepto de obediencia en Schmitt, quien pretende trascender el positivismo jurdico en su bsqueda de un orden jurdico efectivo.Seguidamente desarrolla la relacin existente entre el concepto de legitimidad propuesto por el filsofo y jurista alemn y los tipos
