Zowel publieke als private organisaties maken in Nederland gebruik van camera’s langs de weg om het verkeer te monitoren. Zo beheert Rijkswaterstaat 3.000 camera’s om verkeersstromen te monitoren langs wegen, tunnels en bruggen. De politie, de Koninklijke Marechaussee (KMar) en het Openbaar Ministerie (OM) gebruiken soortgelijke camera’s voor opsporings- en handhavingsdoeleinden. Deze camera’s kunnen automatisch kentekens herkennen van passerende voertuigen, zodat bijvoorbeeld trajectcontroles kunnen worden uitgevoerd of voortvluchtige personen kunnen worden aangehouden. Tot 2019 was het gebruik van deze camera’s beperkt tot het registeren van een overtreding of het registreren van een voertuig dat gesignaleerd stond. Sinds 1 januari 2019 is het mogelijk om met deze camera’s kentekengegevens van alle passerende voertuigen voor een periode van vier weken op te slaan en aan opsporingsambtenaren die het onderzoek uitvoeren te verstrekken. Zij kunnen daarnaast een foto van het voertuig ontvangen. De inzittenden van het voertuig moeten door een daartoe geautoriseerde opsporingsambtenaar onherkenbaar worden gemaakt. Op basis van het nieuwe artikel 126jj Wetboek van Strafvordering (hierna 126jj) kan de politie deze gegevens inzien ten behoeve van de opsporing van een misdrijf of van voortvluchtige personen. De wet is na invoering gemonitord en geëvalueerd. De wet was op het moment van inwerkingtreding tijdelijk van aard, maar is mede op basis van de resultaten uit de evaluatie permanent geworden. In het onderhavige artikel wordt ingegaan op de ontwikkeling van automatische nummerplaatherkenning in Nederland, de achtergrond en juridische aspecten van de nieuwe wet en ten slotte op de belangrijkste bevindingen uit de evaluatie.
