Abstract
The right to the protection of the health, consecrated in\nthe quarter article of the General Constitution of the Republic\nhas, on one hand, a programmatic connotation, at the same\ntime that it is also considered individual guarantee. According\nto the above-mentioned it becomes necessary to specify that\nthe medical errors for negligence or imprecision caused in\nthe benefit of medical care services in public institutions, are\nnot, for their own nature, infringing acts of the right to the\nhealth. To understand the dimension of this right, it is\nnecessary to keep in mind what prepares the sanitary\nlegislation as for the purposes that should complete the\nservices of health and the medical care services that on the\nwhole look for to protect, to promote and to restore the\nperson�s health and of the collective; of there their so much\nnature of social right as of individual guarantee.
