Abstract
A travers ce travail de réflexion, nous analyserons la problématique du voile dans sa dimension juridique mais également dans sa dimension éthique en rapport avec les droits et libertés fondamentales. Nous verrons comment un même droit de l’homme - la liberté religieuse - peut être reçu de manière différente dans le monde. Nous avons opté, pour ce faire, pour une étude de droit comparé. En parcourant les systèmes juridiques de la France, la Belgique et du Canada de manière critique, nous tenterons d’offrir au lecteur une photographie du droit actuel relatif aux signes religieux et plus précisément, au voile islamique. Nous verrons dans quel sens évolue le droit de ces trois pays sur la question du port du voile, intégral et non intégral.
