Abstract
Les procès climatiques se multiplient en 2020-2021, signe que l'environnement préoccupe les Suisses. Après l'Australie ou le Portugal, et d'autres habitués des incendies estivaux, l'Ouest canadien a pris feu en été 2021. Ailleurs, ce sont des inondations et même des décès qu'il faut déplorer (en Allemagne notamment). Dans ce contexte dramatique, la Journée 2020 examine les possibilités, mais aussi les limites, du droit de la responsabilité civile en tant qu'instrument de protection de l'environnement. L'examen de ces questions pressantes a été confié à différent·e·s spécialistes - avocat·e·s ou professeur·e·s - en commençant par les aspects politiques (L. Recordon) et passant du droit public au droit privé (R. Mahaim, A. Refondini, A.-C. Favre et I. Romy), avec l'éclairage particulier du droit international (M. M. Mbengue) et le concours inattendu de la CEDH (D. Raedler), sans oublier l'assurabilité des risques environnementaux (V. Brulhart). Le présent ouvrage rassemble les contributions des intervenant.e.s et répond aux préoccupations nées des catastrophes récentes.
