Abstract
Esta investigación pretende aclarar las relaciones históricas existentes entre la tradición europea occidental y el subsistema latinoamericano con respecto a la regulación de la datio in solutum. El análisis se centra especialmente en aquellos códigos en los cuales dicha figura jurídica ha sido expresamente regulada. Debido a la importancia de la datio in solutum necessaria en los ordenamientos latinoamericanos y en el desarrollo del deber de cumplimiento -principio aliud pro alio invito creditore solvi non potest-, este estudio comprende no sólo la datio in solutum voluntaria, sino también el nombrado beneficium. Para el efecto se analizan las fuentes romanas y medievales pertinentes, así como la recepción de la datio in solutum en las codificaciones europeas y latinoamericanas.
