Abstract
Di fronte al costante acuirsi delle difficoltà del meccanismo di risoluzione delle controversie dell’Organizzazione mondiale del commercio, il cui funzionamento è compromesso dal dicembre 2019 a causa della persistenza del veto statunitense alla nomina dei nuovi membri dell’Organo d’appello, l’Unione europea ha reagito con una strategia a tutto campo per preservare e rafforzare una governance degli scambi internazionali imperniata anche su un contenzioso capace di promuovere il pieno rispetto delle regole internazionali. Il presente lavoro è dedicato all’analisi di tale strategia, ricostruendo l’azione europea per istituire e gestire il Multi-Party Interim Appeal Arbitration Arrangement in seno all’OMC, il contenzioso bilaterale avviato nei meccanismi di risoluzione delle controversie degli accordi di libero scambio di nuova generazione dell’Unione europea, e le misure unilaterali di cui l’UE si è dotata per garantire il rispetto degli impegni internazionali anche laddove consultazioni e procedure dinanzi ai panels non producano il superamento delle dispute.
