Abstract
In the Spanish legislation on disability, and coinciding with the United Nations, the most important support figure for people with disabilities is de facto guardian. In the mental health field, although controversy still exists, acting in a propositional way is a matter of restorative justice. Outpatient involuntary psychiatric treatment not being penal is regulated in Canada, Australia, New Zealand, Asia, USA, United Kingdom and the Netherlands, but is not in Spain. In this contribution, the Spanish Government’s incongruity when intending to modify the article 763 of the Law on Civil Procedure will be mainly emphasised
