Muuttoautojen verokohtelu Suomessa

Abstract
Tutkielman tavoitteena on verrata Suomen autoverolain ja Euroopan Unionin direktiivien eroja koskien maahan muuttavan henkilön muuton yhteydessä tuoman yksityistalouteen kuuluvan käytetyn verollisen ajoneuvon verokohtelu Suomessa. Lisäksi tavoitteena on tutkia mahdollisia muutoksia ja sen vaikutuksia Suomen autoverotukseen Euroopan Yhteisöjen tuomioistuimen antaman ratkaisun (C-101/00) jälkeen.\nTutkielmassa esitetään Suomen autoverolain mukainen muuttoautojen vero-kohtelu sekä Euroopan Unionin Direktiivien määrittelemä verokohtelu. Näiden väliltä pyritään löytämään ja todistamaan eroavaisuuksia, jotka Suomen tulisi yhdenmukaistaa vastaamaan EU-lainsäädäntöä. Tutkielmaani tehdessäni olen perehtynyt mm. alan kirjallisuuteen, Suomen lakiin, Euroopan Yhteisöjen säädöksiin, lain esitöihin, asetuksiin, ennakkoratkaisuihin ja korkeimman hallinto-oikeuden päätöksiin. \nSuomen autoverolaki on osoittautunut etenkin maahan muuttavan henkilön muuton yhteydessä tuoman ajoneuvon osalta suomalaisia Euroopan Unionissa syrjiväksi. Laki pohjautuu liikaa aikoinaan jo vanhaksi käyneiksi, arviopohjalta abstraktin kaavamaisesti luotuihin kriteereihin, joiden mukaan autovero ja siihen liittyvät alennukset määritellään likimääräisesti. Autoja maahantuovat, etenkin yksityishenkilöt, asetetaan eriarvoiseen asemaan. Lisäksi laista huokuu sen vanhanaikaisuus ajoittuen aikaan, jolloin suomalaisia ei juurikaan ollut töissä ulkomailla eikä Suomi ollut vielä Euroopan Unionin jäsen.
