Abstract
VUOKRA-ASUMISEEN LIITTYVÄT ONGELMAT – VUOKRASOPIMUKSEN IRTISANOMINEN, PURKAMINEN JA HÄÄTÖMENETTELY \n \n \nOlen työssäni tuonut esille Suomen yleisimmät asumismuodot ja selvittänyt niiden toimintaperiaatteet. Opinnäytetyöni pääpaino on kuitenkin asumisen ongelmatilanteiden ratkaisussa; sopimuksen irtisanomisessa, purkamisessa sekä häätöprosessin kulussa aina häädön syistä ja taustoista lähtien häädön täytäntöönpanoon asti. Työssäni vastaan muun muassa kysymyksiin: Millä perusteella vuokranantajan on mahdollista joko irtisanoa tai purkaa sopimus? Miten haetaan häätöperuste? Miten haen tuomioon täytäntöönpanon? Tämän työn tavoitteena on antaa vuokravälittäjille ja vuokralaisille tieto häätöprosessin etenemisestä aina häädön täytäntöönpanoon asti. \n \nHäädön toimittaa aina ulosottoviranomainen hakijan käräjäoikeudelta saaman häätöperusteen mukaan. Kun asia tulee ulosottoviranomaisella vireille, lähetetään vireilletuloilmoitus häädettävälle. Se sisältää muuttokehotuksen muuttopäivineen ja mahdollisen laiminlyönnin johdosta myös häätöpäivän. \n \nJos häädettävä ei ole muuttanut huoneistosta muuttopäivänä on ulosottoviranomaisen tehtävänä poistaa häädettävä tiloista, ulosmitata omaisuus jolla on myyntiarvoa, hävittää vähäarvoinen omaisuus ja säilyttää ainutlaatuinen erityisomaisuus. Häädöstä syntyneet kulut kuuluvat häädettävän maksettavaksi. \n \nHäädettävälle häätö on raskas toimitus. Huolimatta siitä, mistä syystä häätö toteutetaan, on joka tapauksessa kyse pakkotoimenpiteestä. Uuden asunnon saanti ei ole helppoa tietoisena siitä että luottotiedoissa saattaa näkyä merkintöjä vanhemmista häiriöistä. Sosiaaliviranomaisilla on velvollisuus auttaa lapsiperheitä ja vanhuksia ja puuttua myös tilanteeseen jos tie näyttää nousevan pystyyn häädetyillä. \n \nOpinnäytetyö on toteutettu tutkimalla aiheesta kirjoitettuja kirjoja, verkkokirjoja ja Internet-lähteitä sekä omaan kokemukseen perustuen. Opinnäytetyö sisältää myös joitakin liitteitä, joita käytetään häätömenettelyssä ja jotka olen pyytänyt paikalliselta ulosottovirastolta. Kirjasta nimeltä "Yrityksen asiakirjat" olen myös muokannut joitakin vuokraukseen liittyviä asiakirjoja kuvaamaan koko vuokra-asumisen kaarta.
