Abstract
Des soins futiles sont parfois demandés par des patients ou leurs proches et, en retour, de tels soins sont parfois administrés par les soignants. Cet essai vise à réfléchir aux principaux enjeux individuels associés à la futilité médicale. Nous débuterons par une analyse juridique de ce phénomène en étudiant les droits et obligations des protagonistes concernés. Nous poursuivrons ensuite avec une analyse éthique de la situation des patients, des soignants ainsi que des proches des patients. Finalement, nous proposerons certaines pistes de solution afin de prévenir la futilité médicale et mieux gérer les situations dans lesquelles elle survient.
