Abstract
La judiciarisation de l’internement psychiatrique vise à affirmer l’égalité des personnes souffrant de troubles mentaux. Il s’agit donc pour les tribunaux, au-delà du formalisme, de jouer un rôle actif de protection des droits fondamentaux, notamment en évacuant du processus décisionnel toute dimension clinique ou sociale. L’étude empirique, réalisée au Québec, permet de mettre en lumière des difficultés importantes dans l’accomplissement de ce rôle par les tribunaux. La reproduction des inégalités ainsi que le « rôle thérapeutique » du tribunal se matérialisent par des atteintes aux droits considérées comme un moindre mal dans la mesure où l’internement est cliniquement ou moralement justifié. La justice est donc mise en scène dans la mesure où elle sert dans les faits à d’autres fins que celles qui lui sont expressément dévolues.
