En el momento actual, en el que en España parecen abrirse las puertas a una jurisdicción universal en materia de crímenes de derecho internacional, resulta de interés científico conocer las experiencias de otros Estados. Aquí se presenta el caso de Canadá, país cuya particular trayectoria en la materia ha merecido la calificación de "made in Canada solution". A diferencia nuestra, Canadá tiene una historia social, política y jurídica en este ámbito marcada por la entrada en el país de numerosos criminales nazis tras la Segunda Guerra Mundial. Entonces y por algunos años, del país pudo decirse que era un “refugio seguro” para aquellos individuos que hubieran cometido dichos crímenes. Tales fueron las críticas y denuncias que en múltiples ocasiones, el Gobierno canadiense se vio compelido a declarar públicamente lo que hoy sigue afirmando cada vez que presenta su Programa anual sobre Crímenes de Guerra: “The policy of the Government of Canada is unequivocal. Canada will not be a safe haven for persons involved in war crimes, crimes against humanity or other reprehensible acts”. Que Canadá no sea hoy un refugio seguro para tales criminales es una afirmación que ha de corroborarse no sólo con un análisis de su legislación, sino también con el estudio de las políticas criminales de la fiscalía y la práctica de los tribunales. Lo que sí puede afirmarse a priori es el empeño de este país por lograr que no lo sea a lo largo de una trayectoria iniciada a mediados de los años setenta y que perdura hasta nuestros días. Además, parece oportuno analizar el camino seguido en el orden interno por un país que en el orden internacional ha mostrado un interés implacable en la lucha contra la impunidad. La legislación actual en la materia - Ley de crímenes contra la humanidad y crímenes de guerra, de 29 de junio de 2000 - está directamente marcados por las reformas legales y prácticas judiciales anteriores. Tal como indica su preámbulo, el objeto y fin de esta Ley es incorporar el Estatuto de Roma de la Corte Penal Internacional de 18 de julio de 1998, enmendando a su vez varias leyes canadienses.
