Abstract
Cette recherche se veut une analyse de l’évolution des discours juridique et médical dans l’interprétation du « crime » de tentative de suicide. Afin de donner un sens à la déconstruction juridique de ce crime, nous avons étudié les procès pour tentative de suicide au Québec de 1892, année du premier Code criminel canadien, à 1972, année de la décriminalisation. Les conclusions illustrent qu’au XXe siècle, le discours médical a pris une place toujours plus importante dans les tribunaux québécois en matière de tentative de suicide, alors que la psychiatrie se développe dans la province. On assiste alors à un glissement dans la forme du contrôle social des individus qui commettent des tentatives de suicide, c’est-à-dire que le contrôle social pénal est progressivement remplacé par un contrôle social thérapeutique. Le point culminant de cette transformation est la décriminalisation de la tentative de suicide en 1972.
