Abstract
D’importants assouplissements aux principes de protection de la loi Littoral du 3 janvier 1986 sont issus des récentes lois sur l’énergie, la fragilisant davantage. Pour sa part, la jurisprudence administrative poursuit son travail de précision et d’équilibre au fil des (nombreux) contentieux sur le régime des constructions et aménagements dans l’espace littoral (extension en continuité des zones déjà urbanisées, extension limitée de l’urbanisation dans les espaces proches du rivage, protection des espaces remarquables terrestres et marins. La pollution atmosphérique due aux navires reste d’actualité avec le fin mot du contentieux relatif à l’Azura. Le régime applicable aux énergies renouvelables en mer s’affine même si la simplification n’est pas encore au rendez-vous. La protection des petits cétacés protégés du golfe de Gascogne par la France a été jugée insuffisante par le Conseil d’État comme par la Commission européenne.
