Abstract
La question des droits des autochtones trouve son fondement dans la tradition juridique internationale. Dès lors, cette étude suit l'évolution du droit international et de l'expérience canadienne à cet égard. Dans une première partie, cette étude analyse l'évolution au fil de l'histoire des relations entre les peuples autochtones du Canada et les puissances coloniales. Dans une deuxième partie, elle situe la montée du mouvement autochtone sur la scène internationale dans le contexte de l'évolution du droit à l'autodétermination et des droits de la personne. L'étude fait état de l'émergence contemporaine d'un véritable droit autochtone constitué, en partie, par certains droits pré-existants et reconnus. Elle démontre l'inter-relation entre la situation canadienne et les progrès au niveau international et comment la situation juridique actuelle pourrait répondre aux aspirations autochtones, tout en les réconciliant aux intérêts des pays affectés
