IMPLIKASI ADOPSI PROTOKOL MONTREAL TERHADAP PENGENDALIAN DAN PERDAGANGAN OZONE DEPLETING SUBSTANCES DI TIONGKOK

Abstract
Protokol Montreal merupakan salah satu “Multilateral Environmental Agreement” (MEAs) tentang peraturan penggunaan bahan-bahan yang berpotensi untuk merusak lapisan ozon (Ozone Depleting Substances) yang diratifikasi dan diadopsi oleh Tiongkok. Sebelum Tiongkok meratifikasi Protokol Montreal pada Amandemen London di tahun 1991 yang sudah menjamin pendampingan teknis, pendanaan dan transfer teknologi, Tiongkok masih ragu untuk bergabung dengan Protokol Montreal karena khawatir akan kondisi perdagangan industri yang berkomoditas utama dan menggunakan ODS akan mengalami kerugian dan penurunan. Dengan menggunakan teori realisme bahwa negara selalu mementingkan kepentingan nasionalnya termasuk dalam memutuskan untuk bergabung dengan sebuah perjanjian atau rezim internasional, dan mempertanyakan apa yang negara dapatkan setelah bergabung dalam sebuah perjanjian internasional, serta dengan teori tentang arti penting international agreement sebagai tata kelola (good governance) global dalam perlindungan lingkungan, peneliti menganalisis apa yang menjadi implikasi Protokol Montreal terhadap Tiongkok. Penelitian ini membahas bagaimana Protokol Montreal diadopsi dan berimplikasi terhadap pengendalian ODS di Tiongkok dan pada sektor perdagangan pada industri kimia yang menggunakan ODS sebagai komoditas perdagangan utama melalui tingkat nilai investasi asing (FDI), impor ekspor. Dan menganalisis bagaimana Protokol Montreal menjadi salah satu perjanjian internasional yang efektif dan menjadi langkah strategis Tiongkok untuk mewujudkan pertumbuhan dan pembangunan yang ramah lingkungan sesuai cita-cita Tiongkok dan dunia untuk masa depan yang berkelanjutan.
