Abstract
Dans le cadre du présent mémoire, l'auteur étudie la protection que la législation fédérale confère aux tiers détenteurs de secrets industriels en vertu de l'article 20 (1) a) de la Loi sur l'accès à l'information. Après avoir analysé les principes généraux qui constituent l'assise du droit d'accès à l'information, l'auteur cherche à cerner les éléments définitionnels qui caractérisent les secrets industriels. Afin de procéder à une étude complète de la question, l'auteur examine également les notions de secrets industriels que l'on retrouve en common law ainsi qu'en droit civil québécois. Par la suite, l'auteur tente de démontrer qu'en raison du caractère hautement technique propre aux secrets industriels, la Cour fédérale devrait faire preuve d'une certaine déférence à l'égard de cette catégorie d'informations et que, par conséquent, la norme de révision devrait être celle du déraisonnable simpliciler.
