Le 16 octobre 2008, l’Organe d’appel de l’OMC a rendu son rapport dans le litige opposant les Etats-Unis et le Canada d’un côté et la Communauté européenne de l’autre, concernant les suites du fameux contentieux sur la viande aux hormones. Si ce rapport ne tranche pas l’affaire au fond, il aborde de front la question du mandat des groupes spéciaux de l’OMC face aux éléments scientifiques contenus dans les litiges dont ils sont saisis : recours aux experts, traitement des informations scientifiques, notion d’incertitude scientifique font l’objet d’une mise au point significative par l’Organe d’appel. A travers une condamnation assez ferme du raisonnement développé en première instance, celui-ci réaffirme par ailleurs le libre choix du niveau de protection approprié pour chacun des Etats parties.
