Abstract
Gli ultimi interventi di riforma del processo tributario hanno comportato l’accelerazione della fase cautelare, l’impugnabilità delle relative ordinanze, la rilevanza degli “indici sintetici di affidabilità” ai fini della garanzia e la possibilità di definire il giudizio con sentenza in forma semplificata in esito alla domanda di sospensione. Tali misure testimoniano una rinnovata attenzione del legislatore verso uno snodo del processo tributario, quello cautelare, storicamente trascurato, ma fondamentale nell’assicurare l’effettività della tutela giurisdizionale. Ripercorrendo le tappe che hanno condotto all’istituzione e al rafforzamento del giudizio di sospensione dell’atto impugnato, il contributo intende individuare la ratio degli interventi legislativi più recenti e i vuoti di tutela residui.
