Abstract
Opinnäytetyön tavoite oli selvittää oikeustarkastelun kestävät reunaehdot luvatonta rakentamista koskien. Tutkimuksen kohteena oli etenkin kiinteistörekisteriselvitysten yhteydessä ilmitulleet, vanhat luvattomat rakennukset. Tutkimusta voi soveltaa myös muissa tapauksissa luvattomien rakennusten kanssa. Rakennukset, joiden loppukatselmus on jäänyt suorittamatta, kuuluvat myös tähän luvattomassa tilassa olevien rakennusten kategoriaan. \n \nTutkimus toteutettiin tarkastellen rakentamista ohjaavia lakeja ja muodostunutta oikeuskäytäntöä keskenään sekä kyselytutkimuksella. Kyselytutkimus lähetettiin kolmen eri kokoisen kunnan rakennusvalvontaviranomaiselle, Suomen jokaiseen maakuntaan Ahvenanmaata lukuun ottamatta. Kyselyn päätarkoituksena oli selvittää tällaisen kehittämistyön tarpeellisuutta, koska vastaavaa tutkimusta ei ole tehty aiemmin. \n \nSuurin osa kyselytutkimukseen osallistuneista kunnista näkee tämän opinnäytetyön tarpeellisena ja siinä on kyselyn tärkein tulos. En pidä sitä yllättävänä ottaen huomioon, että yli puolet kunnista oli tekemässä tai suunnittelemassa kiinteistörekisteriselvitystä, jonka väistämättömänä seurannaisvaikutuksena vanhat, luvattomassa tilassa olevat rakennukset tulevat ilmi. Kuitenkaan toimintaohjeita tämän seurauksen varalle ei ole yleensä kunnissa laadittu. \n \nTyön lopputuloksena laadin oikeustarkastelun kestävät toimintaohjeet kuntien tulkittavaksi, miten luvattomassa tilassa olevia rakennuksia on mahdollista käsitellä. Jokainen kunta on itsenäinen toimija ja siksi toimintaohjeet on tarkoitettu muokattaviksi kuntien omien toimintatapojen mukaan.
