Yritysvastuuta vai vastuun yritystä? : Yritysvastuukehitys Suomen oikeudessa 1990-2022

Abstract
Yritysvastuu on 2020-luvulla kuuma puheenaihe. Tutkielman motivaationa toimi vastuullisuuskysymysten ajankohtaisuus, mikä tekee tutkimusaiheesta myös relevantin ja kiinnostavan. Tutkielman tavoitteena oli selvittää oikeushistoriallisen metodin keinoin ensinnäkin Suomen oikeudessa tapahtunutta yritysvastuumuutosta ja toiseksi hahmottaa tämän kehityksen taustalla vaikuttaneita tekijöitä. \n \nYritysvastuu sisältää nykykäsityksen mukaan kolme ulottuvuutta: sosiaalisen vastuun, taloudellisen vastuun ja ympäristövastuun. Vastuullisuusalueiden ala on alati kasvava. Yritysvastuukäsityksen osalta lähdettiin kuitenkin liikkeelle 1990-luvulla huomattavasti suppeammasta käsityksestä ja muutos nykyiseen laajaan yritysvastuukäsitteeseen tapahtui erityisesti vuosituhannen vaihteen jälkeen. Oikeudellinen kehitys painottuu erityisesti kuluneeseen vuosikymmeneen. Tätä tutkielmaa kirjoitettaessa oli valmistelussa sekä EU:n yritysvastuulaki että kansallinen yritysvastuulaki. Iso osa yritysvastuun sääntelystä perustuu kuitenkin edelleen pehmeään sääntelyyn. Yritysvastuukehityksen taustalla vaikuttaa isot kokonaisuudet kuten globalisaatio ja ihmisoikeuskysymykset, mutta myös joukko pienempiä tekijöitä. Yritysvastuu on globaali ilmiö, joten Suomen yritysvastuukehitys seurailee kansainvälistä kehitystä tiiviisti.
