Abstract
Regeringsformen (RF), Europakonventionen2(EKMR) och unionsrätten upprätthåller på olika sätt grundläggande rättigheter i form av tillgång till domstolsprövning, rättvis rättegång och effektiva rättsmedel. En på senare tid omdebatterad fråga är hur nämnda regelverk förhåller sig till utrymmet för att inför svensk domstol föra en fastställelsetalan jämlikt 13 kap. 2 § rättegångsbalken (RB). En särskild fråga är i vad mån svensk processrätt lämnar utrymme för fastställelse av att en rättighetskränkning skett, utan att kränkningen uttryckligen knyts till en viss rättsföljd. Frågan har stor betydelse inte minst för möjligheten att driva olika former av klimatprocesser i svensk domstol. Genom två nyligen meddelade beslut i mål Ö 7177-23 (Klimattalan) och mål Ö 438-24 (Regionens medgivande) har Högsta domstolen presenterat två delvis olika lösningar på problemet. I den följande uppsatsen diskuterar vi skillnaderna mellan de olika lösningarna och vad de innebär för utrymmet att i framtiden ta klimatanspråk till svensk domstol.
